II. Scope/Jurisdiction/Application
This policy applies to allegations of sex-based hostile environments under its education program or activity, even when some conduct alleged to be contributing to the hostile environment occurred outside the recipient’s educational program or activity outside the United States. Conduct that occurs under a recipient’s education program or activity includes, but is not limited to, conduct that occurs in a building owned or controlled by a student organization that is officially recognized by a postsecondary institution, and conduct that is subject to the recipient’s disciplinary authority.
Such impact includes:
- Any action that constitutes a criminal offense as defined by federal, state, or local law;
- Any situation where it appears that the Responding Party may present a danger or threat to the health or safety of self or others;
- Any situation that significantly impinges upon the rights, property, or achievements of others or significantly breaches the peace and/or causes social disorder; and/or
- Any situation that is detrimental to the educational interests of the College.
